Buying, Selling & Transfers

Do Texas Private Firearm Transfers Require a Background Check?

State law doesn’t require a private-party background check. Federal law does apply if the buyer is a prohibited person, and best practice is to verify before selling.

Texas does not require private-party transfers to run through a background check or an FFL. Federal law also doesn’t mandate a background check for in-state person-to-person sales between two residents of the same state.

The federal catch

Federal law does prohibit selling a firearm to a person you know or have reasonable cause to believe is a prohibited person. If you sell to a felon or someone under a domestic violence protective order, you can be charged federally even without a background check requirement.

How to verify without an FFL

  1. Ask for and inspect a Texas driver’s license or state ID confirming Texas residency.
  2. Ask directly if the buyer is prohibited under any of the federal 4473 categories: felony, domestic violence conviction or order, unlawful drug user, mental commitment, dishonorable discharge, etc.
  3. Don’t sell to anyone whose story doesn’t add up. Trust your gut. If something feels off, walk away.

Voluntary background check option

Any FFL can facilitate a private-party transfer for a fee, running the standard NICS background check. If you want the assurance of a documented federal check, especially for a higher-value firearm, take the buyer to an FFL together. Fee is typically the FFL’s transfer fee.

Bill of sale

Not required, but I do it every time and recommend everyone else does. Include names, IDs, addresses, firearm info (make, model, serial, caliber), sale price, and both signatures. If that firearm shows up in a bad situation years later, you have proof of when it left your hands.

Stay safe. Semper Fi.
